FTAIA bars DOJ forex prosecution, say defendants
Lawyers for traders accused of rigging foreign exchange rates last week told the Manhattan federal court that the US Department of Justice cannot pursue their “wholly foreign” alleged conduct, and that the alleged conduct was procompetitive information-sharing rather than a per se restriction of competition.
