Depends on the plaintiff: The Asia-Pacific Tipline for 12 July 2019
China’s top court has ruled that the standard for enforcing against resale price maintenance agreements depends on who the plaintiff is. If it’s the country’s antitrust watchdog, then the conduct is presumptively illegal; if it’s a private plaintiff, then the anticompetitive effect of the conduct must be shown in court.
