China’s top court: SAMR can treat minimum prices as per se illegal
China’s highest court has ruled that the country’s antitrust watchdog can treat vertical agreements – including resale price maintenance – as per se violations of the Anti-Monopoly Law, but left room for courts to apply the rule of reason.
