EU Competition Law and the Energy Sector 2013 The process of opening the EU energy markets to competition started over 15 years ago. In the meantime, the European Commission (the Commission) has taken numerous steps to further enhance the liberalisation process: it has investigated the sector and with the Energy Packages it has implemented the appropriate legal measures. However, as summarised by the Commission in its communication ‘Making the internal energy market work’, published in November 2012, today the EU and its member states are not on track to meet the deadline set for 2014 to complete the internal energy market.1
