The proactive and diverse approach of Germany’s competition authority, the Federal Cartel Office (the FCO), into digital markets dominated the antitrust debate in Germany and influenced the European and global policy agenda. While more of a national scope, the ministerial approval of the previously prohibited merger in the grocery sector, the EDEKA/Kaiser’s Tengelmann takeover, equally drew quite some attention. Less visibly, but ultimately equally as important economically, private litigation activity on private cartel damages continues to increase in Germany, with several eye-catching cases. Here we will briefly summarise some major developments in those fields.
