Advocacia José Del Chiaro is led by one of the country’s best known antitrust specialists, José Del Chiaro Ferreira da Rosa, a former head of Brazil’s Secretariat of Economic Law (SDE) and a founder member of Ibrac, Brazil’s largest competition-focused group to which most of Brazil’s competition lawyers belong. Del Chiaro is also a nominee in The International Who’s Who of Competition Lawyers and Economists.

The competition team comprises eight experienced partners leading a highly regarded antitrust group. The team is divided between São Paulo and Brasília. The team can also call on the expertise of a recently added intellectual property specialist to assist the team with IP issues in antitrust cases.

This year the team was exceptionally busy, handling Brazilian aspects of the acquisition of MAN by Volkswagen, advising local consumer goods and pharmaceutical leader Hypermarcas in seven acquisitions including a major national pharmaceutical company, and representing Ericsson in its acquisition of Telcordia Technologies.

Advocacia Del Chiaro also has substantial expertise in behavioural cases. It is representing Heineken against Ambev in three abuse of dominance cases, and acting for Philip Morris against the Brazilian arm of British American Tobacco in an exclusive dealing case. The firm is also advising Volkswagen in an abuse of dominance case regarding IP rights.

Advocacia Del Chiaro is also advising companies in many cartel investigations, both domestic and international. It is handling a series of judicial review of cartel investigations for clients that include Bayer and ArcelorMittal, and is heavily involved in private enforcement matters, representing ArcelorMittal in lawsuits that seek to redress cartel injuries.
